Bander Terms of Service

1. Acceptance of Terms

By accessing and using Bander ('Service'), you agree to comply with and be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, you must not use the Service.

2. The Services We Provide

Bander provides a platform that enables musicians to connect with each other, share content, and communicate. The Service includes messaging, profile creation, content sharing, and other features we may introduce from time to time. Bander reserves the right to modify or discontinue any feature at any time without notice.

3. Subscriptions and Fees

Bander will always offer a free tier of service to all users. Owners of relevant businesses (rehearsal spaces, recording studios, etc.) can register for free, but will not be able to message other users or have their business marked on the map. To gain full access to these features, owners must subscribe to a monthly subscription using one of the platforms listed on our Subscription page. Fees are subject to change. Subscriptions can be cancelled at any time, allowing owners to retain access to premium features until the end of their current billing cycle. Bander does not offer refunds for any reason, including website downtimes due to maintenance or updates, although we strive to minimize such disruptions.

4. Account Termination

Bander reserves the right to terminate or suspend your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

5. User Conduct

You agree not to:

• Harass, abuse, threaten, or intimidate other users.
• Post content that is defamatory, racist, bigoted, transphobic, pornographic, or otherwise discriminatory or harmful.
• Engage in unlawful, misleading, or fraudulent activities.
• Impersonate any person or entity or provide false information.
• Send unsolicited or unauthorized advertising, spam, or chain letters.
• Access or collect data from the Service using automated means without permission.
• Use the Service for any unauthorized commercial purpose.
• Upload viruses or malicious code.
• Attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service.

6. Content Responsibility

You are solely responsible for any content you create, transmit, or display while using the Service and for the consequences of your actions, including any loss or damage suffered by Bander or its users. Bander does not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any content posted by users.

7. Limitation of Liability

Bander is not responsible for any damages, whether direct, indirect, incidental, consequential, or exemplary, arising out of or in connection with your use of the Service. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

8. No Warranties

The Service is provided on an 'as is' and 'as available' basis. Bander makes no warranties, express or implied, regarding the Service, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Indemnity

You agree to indemnify and hold harmless Bander, its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Data Privacy

While we strive to protect your personal information, Bander cannot guarantee the security of any information you transmit to the Service and you do so at your own risk. Bander is not responsible for any data leaks or unauthorized access to your data.

11. Intellectual Property

You retain ownership of the content you create and share on Bander. By posting content on Bander, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, distribute, modify, and display your content in connection with the Service.

12. Changes to the Terms

Bander reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Service. Your continued use of the Service after such changes have been made constitutes your acceptance of the new Terms.

13. Governing Law

These Terms and your use of the Service are governed by and construed in accordance with the laws of the jurisdiction in which Bander operates, without regard to its conflict of law provisions.

14. Language and Interpretation

These Terms of Service may be translated into multiple languages for the convenience of our users. In the event of any inconsistencies or conflicts between the translated versions and the English version, the English version shall prevail and be deemed the authoritative text.
